Agreement and eligibility
By downloading or using Luma, you agree to these terms, the Privacy Policy, and the rules of the app store through which you obtained the app. If you do not agree, do not use the app.
You must be legally able to enter this agreement and meet the minimum age required by applicable law and the relevant app store. A parent or legal guardian must authorize use where required.
Your right to use the app
Gamina grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Luma for its intended purpose, subject to these terms.
Your content and instructions
You retain the rights you have in material you submit. You give Gamina and the providers needed to operate the app a limited license to host, copy, transmit, process, and transform that material only as needed to provide, secure, and support the requested features, subject to the Privacy Policy.
You represent that you have the rights, permissions, and lawful basis needed to submit the material and request the processing, especially when it concerns another person, a child, private property, health-related information, or protected creative work.
Acceptable use
- Use the app lawfully and respect the safety, privacy, intellectual-property, publicity, and other rights of others.
- Do not submit unlawful, exploitative, abusive, deceptive, infringing, or malicious material.
- Do not interfere with the app, bypass safeguards, attempt unauthorized access, scrape the service, reverse engineer restricted components, or misuse automated systems.
- You remain responsible for material you upload, enter, create, save, publish, or share through the app.
Purchases and subscriptions
If the app offers paid features, the price and renewal terms shown by the relevant app store at purchase apply.
Payments, renewals, cancellation, refunds, and restore-purchase functions are handled under the policies of Apple, Google, or the applicable store.
Third-party services
The app may rely on or link to the third-party services identified in its Privacy Policy or in the feature where they are used. Their own terms and policies apply to the services they control. Gamina is not responsible for an independent provider’s availability, content, pricing, or transactions.
Gamina materials
The app, its software, branding, interface, and Gamina-provided content are owned by Gamina or its licensors and are protected by applicable intellectual-property laws. These terms do not transfer ownership or permit commercial reuse except where a feature expressly allows it.
Important limitations
- Luma is a general-wellness tool and is not a medical device.
- Camera heart-rate and HRV estimates can be affected by movement, temperature, lighting, hardware, breathing, and fingertip placement.
- Do not use Luma for urgent or clinical decisions. Seek qualified medical care for symptoms or health concerns.
The app is provided on an “as available” basis. To the extent permitted by law, Gamina disclaims implied warranties and is not liable for indirect or consequential loss resulting from use of the app.
Warranty and liability
We do not promise that the app will always be available, uninterrupted, secure, or error-free, or that every result will be accurate or suitable for a particular purpose.
To the fullest extent permitted by applicable law, Gamina’s aggregate liability arising from the app or these terms will not exceed the greater of the amount you paid for the app during the twelve months before the claim or the minimum amount required by law. Nothing in these terms excludes rights or liability that cannot lawfully be excluded.
Suspension and termination
You may stop using the app at any time. We may restrict or terminate access where reasonably necessary to protect users or the service, respond to legal requirements, address non-payment, or enforce these terms. Provisions that by their nature should survive will remain effective.
Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye, without taking away mandatory consumer protections that apply where you live. Courts and dispute procedures are determined under applicable law.
Changes and availability
We may improve, modify, suspend, or discontinue features. We may also update these terms. Material updates will be reflected by a revised effective date or an in-app notice when appropriate.
General terms
If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. These terms, the Privacy Policy, and any app-store or purchase terms presented at checkout form the agreement concerning your use of the app.
